USER AGREEMENT

on the procedure for using the mobile application
1. General Provisions
1.1. This User Agreement (hereinafter referred to as the "Agreement") defines the terms of use of the GoGym mobile application (hereinafter referred to as the "Application"), regulates the rights and obligations of the Administration and Users.
1.2. The Application is a marketplace for searching, booking and providing sports services between Clients, Coaches and Sports Facilities.
1.3. Registration and use of the Application confirm the User's agreement with the terms of this Agreement and the Privacy Policy.
1.4. Application Administration: Company name or IP "TITAN", email: devs@gogym.kz, is the owner of the Application and ensures its functioning.
2. Terms and definitions
2.1. User – any individual or legal entity registered in the Application
2.2. Client/Athlete — an individual who orders and pays for services –
Coach/The instructor - is an entrepreneur who provides sports services
2.3. Sports facility — an organization or entrepreneur providing sports services and rental facilities.
2.4. Account – the User’s account in the Application.
3. Registration and account
3.1. To use the Application, you must register and create an Account by providing reliable data.
3.2. Minors (under 18 years of age) may use the Application through a legal representative.
3.3. Coaches and Sports Facilities are required to confirm the status of an entrepreneur (individual entrepreneur/LLP) and provide the necessary documents upon request of the Administration.
3.4. The User is responsible for the safety of his/her account data and undertakes not to transfer them to third parties.
4. Users rights and obligations
4.1. The User is prohibited from:
– posting false information;
– violating the rights of other Users;
– duplicating accounts;
– committing fraudulent actions;
– using the Application for illegal purposes.
4.2. The User has the right to:
– use the functionality of the Application for its intended purpose;
– leave reviews and participate in ratings;
– contact support to resolve issues.
5. Ratings and reviews
5.1. Users have the right to leave reviews about Trainers, Sports Facilities and Clients.
5.2. Reviews affect the rating, which is taken into account when displaying profiles and promoting services.
5.3. The Administration has the right to delete reviews that violate the rules of the Application (insults, lies, spam).
6. Limitation of Liability
6.1. The Application Administration is not a service provider and is not responsible for their quality, safety, or compliance with expectations.
6.2. Coaches and Sports Facilities are responsible for the provision of services.
6.3. The Administration is not responsible for the losses incurred by the User as a result of the actions of other Users.
6.4. In case of disputes between Users, the Administration may act as a mediator, but is not obligated to participate in the settlement.
7. Personal data
7.1. The User agrees to the processing of their personal data for the purposes of the Application operation, promotion of services and compliance with the law.
7.2. The Administration undertakes to maintain confidentiality and protect personal data in accordance with the Law "On Personal Data".
8. Changes to Terms and Conditions
8.1. The Administration has the right to make changes to the Agreement with mandatory notification of Users via the Application. Continued use of the Application after the publication of a new version of the Agreement means full agreement with its terms.
9. Final Provisions
9.1. This Agreement is valid indefinitely while the User uses the Application.
9.2. All disputes are resolved through negotiations, and if this is not possible - in court at the place of registration of the copyright holder of the application.
